First and foremost, it’s critical to consider whether “personal information”—a broad term that encompasses many types of data—is disclosed or received under an agreement. You must also understand the geographic scope of your deal, which data privacy laws apply (there are over 150 privacy laws worldwide), and the terms that must be included in an agreement to address those laws, including cross-border data transfer safeguards.
