Florida’s hospitality industry is facing a Covid-19 crisis, so I’m not going to waste much time with a flowery introduction. With the inevitable shift to delivery-only facing the state and nation, the firm has been working with its clients to help prepare them for this new reality. For the benefit of the entire community, I’m posting a quick reference guide on which licensees are allowed to deliver to consumers under existing law.

Please check to see whether your business activity has also been constrained by your local officials. Note that all delivered beverage must be in containers sealed by the manufacturer, according to the Division of Alcoholic Beverages in a 2019 declaratory statement. That means no cocktails sealed in plastic wrap and tape by your bartender!

If you are not equipped to make deliveries using your existing staff, please consider using a third party delivery service such as Uber Eats.

Package Sales - Off Premises for Beer and Wine Only (1APS + 2APS)

Deliveries by the licensee directly and through third party delivery services are allowed.

Consumption on Premises Licenses for Beer and Wine Only (1COP + 2COP)

Deliveries by the licensee directly and through third party delivery services are allowed.

Quota Liquor Licenses (Package Sales and Consumption on Premises)

Deliveries by the licensee directly and through third party delivery services are allowed for all quota license types.

Special Food Service (SFS) Liquor Licenses

Deliveries by the licensee directly and through third party delivery services are not allowed.

New: Thanks to action by Governor DeSantis, SFS licensees are allowed to make deliveries directly and through third party delivery services during the declared state of emergency.

Tap Rooms (Breweries w/ Consumption on Premises) and Brewpubs (CMBP Vendors with Breweries)

Deliveries by the licensee directly and through third party delivery services are not allowed.

Special Motel/Hotel: Historic (SH)

Deliveries by the licensee directly and through third party delivery services are allowed.

Special Motel/Hotel: Historic Motel/Hotel in Qualifying Municipalities (SHQM)

Deliveries by the licensee directly and through third party delivery services are not allowed.

Other Specialty Licenses: Bowling (SBX), Airport (SAL), Civic Center (SCX), Special County Commissioner (SCC)

Deliveries by the licensee directly and through third party delivery services are not allowed.

Special Boats – Excursion/Charter (SPX)

Deliveries by the licensee directly and through third party delivery services are not allowed.

Performing Arts Center (11PA-C), Symphony Orchestra (11PA-O), Live Performance Theater (11PA-LT), Special Public Fair/Expos (FEX)

Deliveries by the licensee directly and through third party delivery services are not allowed.

Club Licenses - Lodges, Fraternal Groups, Tennis/Golf/Beach, and Other Clubs

Deliveries by the licensee directly and through third party delivery services are not allowed.

Horse, Dog Track, or Jai Alai Fronton Caterer

Deliveries by the licensee directly and through third party delivery services are not allowed.
