The judge could not have found that the Commonwealth proved beyond a reasonable doubt that the Defendant knowingly or intentionally possessed a controlled substance where the only evidence linking the Defendant to the contraband was the Defendant’s recent occupancy of a vehicle and where the Commonwealth produced no evidence that the Defendant knew what marijuana smelled like.
