Criminal charges have been dismissed against the man who was arrested for throwing a brick through the windshield of an ambulance as it was responding to an emergency in Seattle's Wallingford neighborhood in August.

Prosecutors said their hands were tied because the state's mental health hospital did not admit Dale Cieslinski, 60, for treatment after he was found incompetent to stand trial.

“What the law says is Western State needs to get people in for treatment within a short window of time, and if Western State doesn’t do that, then that’s the situation we find ourselves in - this person is back on the streets without treatment," said Casey McNerthney, the spokesperson for the King County Prosecuting Attorney's Office.
