We talk with Jamal Greene about his book, "How Rights Went Wrong: Why Our Obsession with Rights is Tearing America Apart." He explains how courts have allowed disputes over rights to become zero-sum games that make future compromise impossible. Because of poorly-reasoned court decisions, where the content of the dispute is ignored in favor of literal readings of law, Professor Greene argues fights over abortion, education, homosexuality and guns have left each side to consider the other unworthy of existence. Whether its freedom of speech on campus or the right to purchase a cake for an LGBT wedding - or the right to refuse to bake it - Greene explains how both liberals and conservatives have been made to feel unwelcome in America.
